Judicial findings & psychiatric context
On January 24, 2023 in Duxbury, Massachusetts, 32-year-old labor and delivery nurse Lindsay Clancy strangled her three children,Cora (5), Dawson (3) and Callan (8 months),during a 54-minute window while her husband was out, before attempting suicide by jumping from a second-story window.
The Commonwealth indicted Clancy on three counts of first-degree murder. In July–August 2026 the case was tried before Judge William F. Sullivan in Plymouth Superior Court. The central issue was lack of criminal responsibility under Commonwealth v. McHoul (1967).
After testimony from defense expert Dr. Phillip Resnick and prosecution experts Dr. Kirk Heilbrun and Dr. Gregory Saathoff, plus evidence of rapid polypharmacy, the case was submitted to the jury on August 27, 2026. Jury deliberations are ongoing. Mistrial declared Friday, September 4, 2026, no verdict. If found not guilty by reason of lack of criminal responsibility, commitment would be civil to a DMH facility (e.g., Tewksbury), no order has been issued.
"A person is not criminally responsible for their conduct if, at the time of such conduct as a result of mental disease or defect, they lack substantial capacity either to appreciate the criminality of their conduct or to conform their conduct to the requirements of law."
